Man ordered to pay Dh60,000 for repeatedly making phone calls and causing emotional distress.

Date:

The case led to criminal proceedings, where the defendant was found guilty of intentionally causing nuisance and disturbance through repeated phone calls.

A man has been ordered to pay a total of Dh60,000 in compensation after being found guilty of repeatedly harassing another man through persistent phone calls that caused emotional distress and mental suffering in the United Arab Emirates.

The court also directed the defendant to pay an additional Dh9,000 to the victim, following an earlier criminal court ruling that had awarded Dh51,000 as temporary compensation in the same case.

According to court records, the victim filed a civil case seeking Dh100,000 in compensation for moral and emotional damages, alleging that the defendant intentionally caused distress by repeatedly calling him over a period of time in the United Arab Emirates.

The case had earlier gone through criminal proceedings, where the defendant was convicted of intentionally causing nuisance and disturbance through repeated phone calls in the United Arab Emirates.

During the civil case, the defendant argued for dismissal, claiming the key elements of civil liability were not fully proven and that compensation had already been granted through the criminal ruling.

However, the court ruled that criminal judgments are binding in related civil cases when they establish the occurrence of the offence, its legal classification, and the accused’s responsibility. It noted that official records and the prior criminal judgment confirmed the defendant had deliberately caused emotional distress through repeated phone contact.

The court concluded that the victim had suffered moral and emotional harm and set fair compensation at Dh60,000. Since Dh51,000 had already been awarded earlier as temporary compensation, the court ordered the defendant to pay the remaining Dh9,000, along with court fees and legal expenses.
