Ajman Court Shows Leniency Due to Family Ties Despite Medical Report Confirming Son’s Injuries.

Ajman: The Ajman Federal Court of First Instance has imposed a Dh1,000 fine on a 33-year-old Gulf national woman after finding her guilty of assaulting her son with a microphone, causing injuries that affected his ability to carry out normal daily activities for up to 20 days.

The court convicted the mother under Article 390(2) of the UAE Crimes and Penalties Law and ordered her to pay the associated court fees.

In determining the penalty, the court took into account the family relationship between the accused and the victim, granting leniency because the injured child was her son.

Family dispute leads to assault

According to court documents, the incident began following a disagreement between the boy and his sister.

During the dispute, the mother intervened and struck her son on the head with a microphone, resulting in injuries.

The boy also suffered additional injuries after being bitten by a dog belonging to his mother.

The matter was brought to the attention of authorities when the child’s father filed a police complaint reporting the alleged assault.

Following the complaint, police registered the case and referred it to the Public Prosecution, which subsequently initiated criminal proceedings against the mother.

Medical report confirms injuries

A medical examination established that the boy had sustained injuries that temporarily limited his ability to perform routine daily activities.

According to the medical report submitted as evidence, the effects of the injuries lasted for a period of up to 20 days.

The court considered the medical findings alongside the circumstances of the incident before issuing its judgment.

Although the mother was found guilty of assault, the court exercised leniency in view of her relationship with the victim, imposing a Dh1,000 fine and requiring her to cover the court fees.

Mother denies assault allegations during court proceedings

The mother rejected the assault allegations throughout the investigation and continued to maintain her innocence when she appeared before the Ajman Federal Court of First Instance via video link.

Her defence lawyer submitted a written memorandum requesting an acquittal, arguing against the charges brought before the court.

However, the Public Prosecution maintained that the available evidence supported a conviction and urged the court to find the defendant guilty.

Court relies on victim’s testimony and medical evidence

In its judgment, the court determined that the boy’s statements during the investigation were consistent with the findings of the medical examination.

The medical report confirmed the injuries sustained by the child and provided supporting evidence connecting them to the reported incident.

After examining the case documents and arguments presented by both sides, the court concluded that the defence submissions were insufficient to challenge the prosecution’s evidence.

The judge therefore found the mother guilty of assault.

Family relationship considered in sentencing

When determining the appropriate punishment, the court considered the relationship between the accused and the victim.

Although the evidence established the offence, the court exercised leniency because the defendant was the injured boy’s mother.

As a result, the court imposed a Dh1,000 fine and ordered the woman to pay the applicable court fees.

The ruling reflected the court’s decision to uphold the assault conviction while taking the family circumstances into account when determining the sentence.
